Terms of Service

Welcome to AuctionEye ("we", "us", "our"), operated under the domain myauctioneye.com. By creating an account or using the Service you agree to these Terms.
1. The Service
AuctionEye provides automated analysis of vehicle auction lots and vehicle history reports, including data sourced from the National Motor Vehicle Title Information System (NMVTIS) through our authorized data provider, market valuation comparisons, and scraped public auction listings.
2. Permitted Use
Reports are licensed to the requesting user for that user's personal or internal business use only. You may not:
- Resell, republish, rent, or redistribute reports or data.
- Use the Service to populate a competing database or product.
- Scrape, crawl, or bulk-download without written authorization.
- Reverse-engineer the analyzer or circumvent rate limits.
3. Accounts and Billing
Paid plans renew monthly. Pay-per-report charges are one-time. You may cancel from your Dashboard at any time; access continues until the end of the current billing period. Payment processing is handled by Stripe, subject to Stripe's own terms.
4. Data Accuracy and No Warranty
Important: NMVTIS data reflects what state DMVs and insurance/junk/salvage operators have reported, which may be incomplete or delayed. Market values are estimates derived from third-party sources. Analyzer verdicts ("Deal / Neutral / Trap") are advisory and do not guarantee any outcome.
The Service is provided "AS IS" without warranty of any kind. We are not responsible for any bid, purchase, or financial decision made using AuctionEye. Always perform your own due diligence before bidding.
5. Limitation of Liability
To the maximum extent permitted by law, our total liability for any claim arising out of the Service is limited to the amount you paid us in the twelve (12) months preceding the claim. We are not liable for lost profits, lost sales, or indirect or consequential damages.

6A. AuctionEye Scout Services
If you request that we bid on a lot on your behalf (the "Scout Service", formerly "Brokerage Service"), the following additional terms apply:
- We operate as a US-licensed Independent Auto Dealer and bid at Copart, IAAI, and other auction houses in our name, then transfer title to you upon payment.
- A deposit is required before we will submit a bid. We never request or collect deposits through a form or landing page — once a bid request is received, our team contacts you directly by WhatsApp or email to verify identity, confirm the vehicle, and agree deposit terms one-on-one. - You authorize us to bid up to your stated maximum bid ("Max Bid"). We will not exceed your Max Bid. We will not guarantee we win any specific lot.
- All auction fees, gate fees, storage, transport, ocean freight, customs documentation, duties, and destination charges are passed through to you at cost. We disclose our flat commission separately on your invoice.
- We do not warrant the condition, mileage, title status, or operability of any auction lot. All vehicles are purchased as-is from the auction. You are responsible for reviewing the Copart/IAAI lot details and images before authorizing us to bid.
- For export purchases: customs clearance, duties, VAT/IVA, and destination-country compliance are solely your responsibility. We provide required export documents (bill of sale, BOL, title) but do not guarantee acceptance by any foreign customs authority.
- Title transfer timelines depend on the state issuing the title and are typically 30–60 days from auction.
Limit of Scout liability: Our total liability in connection with any Scout transaction is limited to the commission paid for that specific transaction. We are not liable for auction-lot defects, customs rejections, shipping damage (covered by ocean carrier insurance where applicable), or loss of resale value.
7. Termination
We may suspend or terminate accounts that breach these Terms, abuse the Service, or engage in unlawful activity.
8. Changes
We may update these Terms. Material changes will be notified by email or on the site at least seven (7) days before taking effect.
9. Governing Law
These Terms are governed by the laws of the State of Florida, USA. Disputes shall be resolved in the state or federal courts located in Orange County, Florida.
